Defamation Case: Javed Akhtar Vs Kangana Ranaut

Javed Akhtar had filed a case against Kangana Ranaut under sections 499 (defamation) and 500 (punishment for defamation) of the IPC.

The application refers to an interview in which Kangana makes allegedly defamatory allegations against Mr. Akhtar and links him to the death of actor Sushant Singh Rajput.

Both the party had previously met each other at a previous hearing of the court. However, later Kangana didn’t attend the next few hearings.

The court, on Monday, 14th September 2021, summoned Kangana to an upcoming hearing with a warning that if not attended, then a warrant will be issued against her. The Mumbai court had earlier summoned Kangana in February, but she did not make an appearance.

However, Kangana’s lawyer, Rizwan Siddiquee, produced a medical report indicating that the actress was suffering from Covid-19 symptoms. Kangana had traveled extensively for promotional purposes in the last 15 days, according to Rizwan Siddiquee, and has met a large number of individuals. Rizwan requested a seven-day extension from the court so that Kangana could heal and take the Covid-19 test. He added, Kangana could also be present via virtual hearing.

On 20th September 2021, when both the parties attended the court hearing, Kangana filed a counter lawsuit against Javed Akhtar, accusing him of criminal intimidation and extortion under sections 383, 384, 387, 503, and 506 of the Indian Penal Court.

Kangana has also said that she has “lost faith” in the court and believed that it’s biased and hence appealed for the transfer of both the cases to a different Magistrate.

The Chief Metropolitan Magistrate will hear the application by Kangana Ranaut to transfer both the case to another court on 1st October 2021.

Previously, the Bombay High Court had denied the request of Kangana to close the defamation filed against her by Javed Akhtar.

After hearing from both parties, Justice Revati Mohite-Dere declared that the magistrate court’s decision commencing the proceedings had no procedural irregularities or illegalities, and the request to close the case was turned down.

Currently, the case of defamation and counter lawsuit of extortion and criminal intimidation is handled by Judge – Metropolitan Magistrate RR Khan.

The Magistrate has given 15th November 2021 as the date for the next hearing.
